1. Mintpay Limited and its subsidiaries, collectively referred to as "Mintpay Group", will make every effort to safeguard the personal data of customers and/or partner organizations in accordance with the provisions of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) ("Privacy Ordinance"). We aim to ensure that the personal data of customers and/or partner organizations is properly protected and not unlawfully used, lost, disclosed, or compromised.
2. At all times, customers and/or partner organizations are required to provide personal data ("Data") to Mintpay Group for the purposes outlined under the Personal Data (Privacy) Ordinance. The data or other information of customers and/or partner organizations may be used for the following purposes:
·Daily operations of services and facilities provided to customers and/or partner organizations.
·Conducting background checks and assisting other organizations in conducting background checks.
·Ensuring good credit maintenance for customers and/or partner organizations.
·Designing services or related products for customer and/or partner organization use.
·Promoting services and related products to customers and/or partner organizations.
·Determining outstanding debts owed by customers and/or partner organizations or debts owed to customers and/or partner organizations.
·Collecting outstanding amounts, interest, and fees from customers and/or partner organizations.
·Complying with any legal or regulatory requirements regarding disclosure requests from partner organizations.
·Any other purposes related to customers, partner organizations, and accounts.
3. The data including other information related to customers and/or partner organizations held by Mintpay Group will be kept confidential. However, Mintpay Group may disclose all data including other information to the following individuals, and customers and/or partner organizations agree that the disclosure of all data including other information is a condition for Mintpay Group to provide services, products, and information to customers and/or partner organizations.
·Senior officials, employees, agents, contractors, or third-party service providers who provide administrative, credit, debt collection, telecommunications, computer, payment, or other services related to the business operations of Mintpay Group.
·Any financial institutions with which customers and/or partner organizations have existing or potential transactions.
·Regulatory authorities and other relevant government agencies.
·Professional advisors of Mintpay Group (including but not limited to auditors and legal advisors).
·Any other individuals responsible for maintaining confidentiality for Mintpay Group, including companies within Mintpay Group that are bound to keep such information confidential.
·The use of customer and/or partner organization data between entities within Mintpay Group shall comply with strict internal security standards, confidentiality policies, and applicable laws.
·Mintpay Group shall ensure that its employees fully comply with these standards, policies, and laws.
·Except for conducting business operations, complying with applicable laws, protecting against fraud or offering products and services that we believe may be beneficial to customers and/or partner organizations' interests, Mintpay Group will not distribute customer and/or partner organization data to other companies. However, Mintpay Group may provide information to regulatory authorities and law enforcement officers in accordance with applicable laws.
·If customers and/or partner organizations agree (including expressing no objection), Mintpay Group may use and/or transfer customer and/or partner organization data to any Mintpay Group companies for direct marketing purposes. The names, contact details, financial background, and statistical data of customers and/or partner organizations held by Mintpay Group from time to time may be used by Mintpay Group for direct marketing of the following products and services: (i) financial services and products; (ii) related promotional programs; (iii) financial and investment advice; or (iv) business promotion and advertising activities related to the aforementioned products or services by Mintpay Group.
4. Mintpay Group is not involved in or responsible for any obligations, duties, or liabilities related to the information and data provided to customers.
5. Mintpay Group may use customers' and/or partner organizations' personal data to send important information (including but not limited to Mintpay communications) via email, postal mail, or text messages regarding services and/or regulatory requirements.
6. In accordance with the terms of the privacy clause, Mintpay Group has the right to charge reasonable fees for processing any requests for data access and review.
7. If customers' and/or partner organizations' data is accidentally, unintentionally, or negligently sent, leaked, issued, or transmitted to third parties within the scope permitted by the privacy clause, customers and/or partner organizations cannot hold Mintpay Group responsible for such actions and cannot seek any compensation, litigation, or legal action against Mintpay Group for any loss or damage incurred.
8. This statement does not limit any rights that customers and/or partner organizations may have under the privacy clause.
9. Requests regarding accessing, correcting personal data, obtaining information about our policies and practices concerning personal data, and requesting the types of personal data we hold should be directed to the following individuals.
